Recently, it has become increasingly apparent to me that a surprising number of contractors are not aware aware of their legal obligations when they lose their qualifier for any reason. If a licensee finds itself without a qualifier, the licensee must file a "Notice of Disassociation or Qualifier Resignation" form with the Utah Division of Occupational and Professional Licensing ("DOPL") within ten (10) days of the disassociation or resignation of the qualifier. If the licensee does not notify the Division in writing within the ten day period, and if the licensee continues to operate as a contractor by soliciting bids or performing work as a contractor, the licensee is violating Utah law and may be subject to, among other things, fines and penalties imposed by DOPL, including suspension of licensure.
On the other hand, if the form mentioned above is filed with DOPL within the ten day period, DOPL permits the licensee to continue to operate as a contractor for sixty (60) days, during which time the licensee may seek another qualifier.
